The rule, in one line
The Social Health Insurance Act 2023, section 27(6), is the statutory basis for the SHA late-payment penalty: 2% per month on any unremitted contribution [Source 1]. This applies to Tier 1 employer remittances that miss the 9th-of-the-following-month deadline, and to Tier 2 member contributions that fall behind their assessed schedule.
How arrears accumulate
Two mechanics stack:
- The missed contribution itself. Every month you owed and did not pay adds one month of your assessed premium to the running balance.
- The 2% penalty on unpaid balances. Each month the arrears remain unpaid, another 2% is levied on the outstanding amount.
The Act does not spell out whether the 2% is compounded (2% on the growing balance including prior penalties) or simple (2% on the original contribution restated each month). In practice, SHA's ledger will show the actual assessed balance for your record on afyayangu.go.ke; the worked examples below use compound interest as the illustrative worst case, but always defer to the SHA-published figure on your account.
Worked example 1: minimum contributor, 3 months missed
Assume a Tier 2 member at the KES 300/month floor, three months in arrears (call them Month 1, Month 2, Month 3), now paying in Month 4.
- Month 1 contribution: KES 300 owed. By Month 4, this is 3 months late. Penalty compounded at 2%: KES 300 × 1.02³ = KES 318.36. Owed for Month 1: KES 318.
- Month 2 contribution: KES 300 owed. 2 months late. KES 300 × 1.02² = KES 312.12. Owed for Month 2: KES 312.
- Month 3 contribution: KES 300 owed. 1 month late. KES 300 × 1.02 = KES 306. Owed for Month 3: KES 306.
- Month 4 contribution (current): KES 300.
- Total owed: KES 1,236 (vs KES 1,200 if there had been no penalty).
On the KES 300 floor, 3 months of missed payments adds only KES 36 in penalty at 2% compounded. This is not the arrears scenario that hurts. The scenario that hurts is a higher assessed contribution, missed for longer.
Worked example 2: KES 2,200/month contributor, 6 months missed
Assume a Tier 1 employee earning KES 80,000 gross, whose SHA is 2.75% = KES 2,200/month. Their employer failed to remit for six months (this is a real Tier 1 scenario, more common with distressed employers than the SHA public narrative admits).
- Month 1 contribution: KES 2,200. Now 6 months late. 2,200 × 1.02⁶ = 2,477.55. Owed: KES 2,478.
- Month 2 contribution: KES 2,200. 5 months late. 2,200 × 1.02⁵ = 2,429.02. Owed: KES 2,429.
- Month 3 contribution: KES 2,200. 4 months late. 2,200 × 1.02⁴ = 2,381.39. Owed: KES 2,381.
- Month 4 contribution: KES 2,200. 3 months late. 2,200 × 1.02³ = 2,334.70. Owed: KES 2,335.
- Month 5 contribution: KES 2,200. 2 months late. 2,200 × 1.02² = 2,288.88. Owed: KES 2,289.
- Month 6 contribution: KES 2,200. 1 month late. 2,200 × 1.02 = 2,244. Owed: KES 2,244.
- Total owed: KES 14,156 (vs KES 13,200 if there had been no penalty). Penalty stack: KES 956 across 6 months.
The penalty on a Tier 1 remittance failure primarily falls on the employer, not the employee, because it is the employer's obligation to remit. See SHA for employers. But the employee suffers the coverage suspension, so it matters practically either way.
Coverage suspension while in arrears
This is the point most members do not fully grasp until they walk into a hospital: SHA cover is contingent on being paid up. If your afyayangu.go.ke ledger shows arrears, the facility cannot bill SHA for your treatment. The specific "how many months late triggers suspension" threshold is not published in a single line on sha.go.ke; observationally, the M-PESA reconciliation lag plus SHA's internal batch means members typically enjoy a short grace before the ledger flips to inactive, but this is not a right, and hospitals check eligibility in real time via eligibility.sha.go.ke.
For confirmation that a payment cleared, see How to check your SHA payment went through.
Two paths to clear
Path 1: pay the full balance to Paybill 200222
If you have the cash to clear the arrears plus penalties in one payment, this is the fastest route. Log into afyayangu.go.ke to check your assessed balance including any penalty SHA has levied, then pay Paybill 200222 with your National ID as account. The M-PESA SMS should show the full amount landing at SHA. Coverage reactivates once the payment reconciles on the ledger, typically within 24 to 72 hours (see how to check your SHA payment).
Path 2: enrol in Lipa Pole Pole
For Tier 2 non-salaried members who cannot pay the full balance at once, SHA runs Lipa Pole Pole: a 24-month structured plan starting with 4 months upfront, then 20 monthly instalments via M-PESA Ratiba or Paybill 200222. No interest. Coverage reactivates when the 4-month upfront amount clears. Full detail: SHA Lipa Pole Pole explained.
Important caveat: Lipa Pole Pole restructures going-forward contributions, it does not automatically waive historic penalty stacks. If your ledger shows accumulated section 27(6) penalties, discuss those with a SHA branch when you enrol.
Who owes what: Tier 1 vs Tier 2
Tier 1 salaried. Your employer owes the contribution and the penalty. The Social Health Insurance Act 2023 places the remittance obligation on the employer. If your payslip shows the deduction but SHA shows arrears, that is a Tier 1 remittance failure by the employer and the penalty falls on them, not you. Your practical problem is coverage suspension, which is why you should check afyayangu.go.ke at least quarterly. See SHA payment not reflecting.
Tier 2 non-salaried. You owe both the contribution and any penalty. Lipa Pole Pole is the intended relief. See SHA for the informal sector.
Unemployed. The realistic figure is the KES 300 floor. See SHA for the unemployed. Missing months still accrue the 2% penalty on the floor, which as shown above is small in absolute terms but does not disappear.
Check your record before you pay
The single most important step before clearing arrears is checking what SHA actually says you owe. Log into afyayangu.go.ke, view your ledger, and note the exact SHA-assessed balance. Pay that amount. Do not pay a self-calculated amount from a compound-interest guess, SHA's ledger is the source of truth.
If afyayangu.go.ke is unavailable or your login is stuck, dial *147# for a contribution-status view, or call 0800 720 601 for a manual balance readout.
