Final tax vs creditable

For non-residents, WHT is generally final tax, once it's withheld, no further filing is needed. For Kenyan residents, WHT is generally a credit you offset against your annual income tax bill at filing.

Who deducts and remits?

The payer (the person paying you) deducts WHT and remits to KRA by the 20th of the following month, then issues you a withholding certificate. Don't accept payment without the certificate, you need it for your tax return.

Why are some rates different for residents vs non-residents?

Kenya bilateral tax treaties give residents lower rates. Non-residents face higher rates because Kenya cannot enforce on offshore filing.

Is rent WHT charged on the gross or net?

On the gross rent received by the landlord, before any expenses. The tenant deducts and remits.

What if WHT was deducted but not remitted to KRA?

You can sue the payer for the amount; you remain entitled to the certificate or to claim the credit on your return.
